1. General Information
These Terms and Conditions govern access to and use of the website www.collectmarketplace.com and the sale of products offered by COLLECTMARKETPLACE srls, with registered office at Via Umberto 111, 95016 Mascali (CT) , VAT No. 06022630872 (“the Seller”).
By accessing or using the Website, and/or purchasing any product, the user agrees to be bound by these Terms and Conditions in their entirety.
Please read them carefully before placing an order.
2. Purpose of the Service
The Website allows users to:
browse the catalogue of available and upcoming products;
place online purchase orders;
receive information regarding products, availability, and shipping.
All prices are listed in Euro (€) and include VAT unless otherwise stated.
Shipping costs are shown separately during the checkout process.
3. Ordering Process
To place an order, the customer must:
select the desired product and add it to the shopping cart;
complete the checkout process by providing the required data;
accept these Terms and Conditions;
complete payment through one of the methods available on the Website.
The order confirmation sent by the Seller via email constitutes acceptance of the sales contract pursuant to Article 1326 of the Italian Civil Code.
4. Preorder Products
Some products on the Website may be available as preorders, meaning they can be reserved prior to their official release or availability date.
The indicated release and shipping dates are estimates provided by manufacturers or distributors and may be subject to change beyond the Seller’s control.
Orders containing preorder items cannot be cancelled or modified after payment confirmation, except within 24 hours of purchase.
By placing a preorder, the customer expressly agrees that such purchase constitutes a binding sales commitment.
The right of withdrawal provided under the Italian Consumer Code (Legislative Decree No. 206/2005) may be exercised only after delivery, within fourteen (14) days, and only if the product is intact, sealed, and unopened.
Once opened or tampered with, the right of withdrawal is void, as the product loses its collectible value and cannot be resold under the same conditions.
5. Products Subject to Market Fluctuations
Pursuant to Article 59, paragraph 1, letter b, of Legislative Decree No. 206/2005, the right of withdrawal does not apply to goods whose price depends on market fluctuations beyond the Seller’s control, which may occur during the withdrawal period.
Collectible products (such as Pokémon boxes, trading cards, limited editions, or special releases) are therefore considered items subject to market value variations.
For these items, no return or withdrawal right is granted once the order has been confirmed, except in cases of defect or non-conformity.
6. Shipping and Delivery
The Seller will ship the purchased products to the address provided by the customer during checkout.
Delivery times are indicative and may vary depending on the courier or unforeseen circumstances.
Any delays or changes to the release dates do not constitute valid grounds for order cancellation or withdrawal.
7. Payments
Payments may be made using the methods available on the Website (e.g., credit card, PayPal, bank transfer, etc.).
All payment data are processed securely in compliance with applicable laws and regulations.
8. Right of Withdrawal
Customers have the right to withdraw from the contract within 14 days of receiving the goods, provided that:
the product is intact, unopened, unused, and still sealed;

Returns are not accepted for:
customized or made-to-order products;
opened or tampered items;
products subject to market value fluctuations or preorders, except in case of product defect or non-conformity.
9. Legal Warranty and Defective Products
All products sold are covered by a 24-month legal warranty of conformity under Articles 128–135 of the Italian Consumer Code.

10. Limitation of Liability
The Seller shall not be held liable for:
